Dear Mr. Bauer:

This responds to your letter dated July 11, 1996,
requesting an advisory opinion on behalf of the Democratic
Senatorial Campaign Committee and the Democratic
Congressional Campaign Committee ("the Committees")
concerning application of the Federal Election Campaign Act
of 1971, as amended ("the Act"), and Commission regulations
to proposed independent expenditures by the Committees on
behalf of their 1996 candidates for the United States Senate
and the United States House of Representatives.

Enclosed is Agenda Document #96-85 which the Commission
considered on August 22, 1996. On that date, the Commission
failed to approve this document by a vote of 3-1 and was
unable to agree to issue any opinion. An affirmative vote
of four members of the Commission is required for the
approval of an advisory opinion. See
2 U.S.C. 437c(c) and 437d(a)(7).

Accordingly, pursuant to Commission regulations at 11
CFR 112.4(a), you are hereby advised that with this letter
the Commission has concluded its consideration of Advisory
Opinion Request 1996-30.
